Tears in the eyes of comedian Apoorva after being released on bail

After a long debate, the bench of Kathmandu District Court Judge Madhav Prasad Mainali on Thursday evening ordered the release of comedian Apurva Kshitij Singh on a bond of two and a half lakhs.  When Kshitij was jailed for what he was doing, tears came to his eyes saying that he felt like committing suicide when he saw what he had done while in jail.
 If this is lost, then anyone can sue anyone, and no one will be able to say anything, saying, ‘I can hardly understand why people leave the country.  No matter what happens, I don’t know, I will leave this case as a winner.  On Thursday, the bench of Kathmandu District Court Judge Madhav Prasad Mainali ordered his release.
Comedian Apoorkshitij Singh’s stand-up comedy has been reported to the police officer under four headings for hurting the New community.  Criminal Code 2074 Chapter-10 of the offense of discrimination and other insulting behavior against him Section 65 shall not disturb public peace, Section 165 shall not disturb the social order, Section 166 shall not engage in untouchability or other discriminatory behavior on the basis of caste and Section 168 insulting or inhuman behavior.
 He was shocked after being accused of a crime that should not have been committed.  According to sub-section (1) of section 65, there is a provision of imprisonment for up to one year and a fine of up to 10,000.  According to sub-section (2) of section 165, there is a provision that the offender may be punished with imprisonment for up to one year or up to 10,000 or both.
Sub-section (2) of Section 166 provides for imprisonment of up to 3 years or a fine of up to 30,000 rupees or both.  “I did not use these words with the purpose of spreading racial impulses and incitement by disrespecting the language, religion, culture, tradition, customs, living conditions of the Newar communities, insulting or inhumane behavior, inciting hatred and anger in the caste harmony and sect, and disturbing the caste harmony and sect,”  He said.
